What changed in the insurance market for AI

Standard Exclusions Exist

Verisk's ISO published three optional generative AI exclusion endorsements, January 2026 edition: CG 40 47 and CG 40 48 for commercial general liability, and CG 35 08 for products/completed operations liability. As of July 2026, carriers are increasingly filing to use them.

Some Exclusions Go Further

At least one carrier's "absolute" AI exclusion for D&O, employment practices and fiduciary liability reaches claims arising out of AI use, AI-related disclosures, and inadequate AI policies, procedures or training.

Affirmative AI Coverage Launched

Specialist programs now write coverage naming AI failures — including a Lloyd's-backed AI liability policy (April 2025) and an AI performance cover (February 2026).

Application Questions Growing

A major broker's 2026 AI fact sheet lists questions carriers are developing: whether a human must verify accuracy before AI acts, whether AI actions are logged, and whether key vendors use AI with safeguards.

Questions companies ask about AI and insurance

How do we answer AI questions on our cyber or E&O application?

Answer accurately and specifically, and attach evidence where the form allows. Start with an inventory of where AI is used. For each use, be ready to say what it does, what data it touches, whether a person reviews its output, what is logged and which vendors are involved. A truthful answer is usually safer than an aspirational one. AIGA helps you build the inventory, controls and evidence behind the answers.

Our insurer added an AI exclusion. What can we do?

Get the exact endorsement from your broker and ask what it reaches, whether it can be narrowed or removed, and whether other markets or affirmative AI coverage are options. AIGA helps with the evidence that supports the conversation: a clear inventory of how your company uses AI, the controls around each use, and records showing those controls work. AIGA cannot promise an exclusion will change.

Our underwriter wants AI controls in place before binding. How do we respond?

Ask your broker for the exact condition in writing and the date it must be met. Separate what you can evidence today from what needs to be put in place, and give each gap an owner and a date. What evidence do underwriters want to see about our AI use?

Underwriters ask where AI is used and whether it faces customers; whether a written policy and approved-tool list exist; whether a person verifies output before AI takes action; whether AI actions are logged; how accuracy and bias are tested; what vendors and models you rely on; who owns the inputs and outputs; and how AI incidents are handled. AIGA builds an evidence index that ties each answer to its record.

Is AIGA an insurance broker? Will you tell us whether we're covered?

No to both. AIGA is not a licensed insurance broker or agent, does not place or sell insurance, and does not contact insurance markets for you. AIGA does not interpret policy wording, give legal advice, price risk, perform actuarial work, test security, validate models, or audit or certify your program. AIGA helps your company govern its AI use and keep the evidence your broker, counsel and underwriters ask for.

For brokers, MGAs and underwriters: if a client's AI use is holding up an application, renewal, questionnaire or pre-bind request, you can refer the client to AIGA. Use the Submit an Information Request form below. Choose "External Referral" or "Partner" as the Lead Source, and put your client's company and the issue in the Project of Interest box. We work for the client, with the client's consent, and return the client to you for every coverage, placement and pricing conversation. We are not a broker and do not compete with you for placement.
